An allegedly fake au pair is set to plead guilty to stealing children after initially intending to fight the charges, a court has heard.

Samantha Azzopardi appeared in the Melbourne Magistrates Court via videolink on Tuesday facing 55 charges including child stealing, theft and deception charges.

It comes after the 32-year-old was arrested at a Myer store in the regional Victorian city of Bendigo where she was found with a 10-month-old and a four-year-old girl in November 2019.

The girls were returned to their parents and Ms Azzopardi was charged with two counts of child stealing.

She was due to face a contested committal hearing about the allegations.

But in a shock twist the woman’s lawyer Jessica Willard told the court the matter resolved.

She said they planned to apply to keep the matter in front of a magistrate, where the penalties are less severe.

Crown prosecutor Kristie Churchill did not oppose the application and told the court Ms Azzopardi was expected to plead guilty to seven charges and they would drop others.

“As I understand it will be a plea of guilty to … three counts of child stealing,” Ms Churchill said on Tuesday.

The third child stealing charge relates to a child Ms Azzopardi allegedly took between March 1 and April 18, 2019.

According to court documents she “by fraud took a child under the age of 16 years with intent

to deprive the mother, stepfather, father and stepmother of the possession” of the girl.

The prosecutor said the charges would be amended but did not detail the changes in court.

Ms Azzopardi is also expected to admit to stealing an iPad.

She also intended to plead guilty to handling stolen goods.

More than two dozen obtain property by deception charges were rolled up into a single offence which Ms Azzopardi is also expected to plead guilty to, Ms Churchill said.

These relate to her purporting to be a qualified au pair and dishonestly obtaining wages, court documents state.

She will face her next court in late April to apply to keep the matter in the magistrate’s court and if that is successful will plead guilty.
